Terms & Conditions

1. About these Terms

1.1 These Terms and Conditions (“Terms”) apply to this website and to every service provided by Tajmol Cyber (“we”, “us”), a cyber services business in Migori, Kenya, to you (“you”, “the customer”).

1.2 Our “Services” are cyber and computer services, printing, photocopying and document services, and online application assistance, whether requested in person, by phone, on WhatsApp or through the website contact form.

1.3 By requesting a service or using this website you accept these Terms. If you do not accept them, please do not use our Services.

1.4 These Terms apply instead of any general terms you may use, unless we agree otherwise in writing.

2. Who we are and what our Services are

2.1 Tajmol Cyber is an independent business. We are not a government agency and are not affiliated with any government institution.

2.2 Our government-related Services are application assistance, portal guidance and document support. Names such as KRA, HELB, KUCCPS, NTSA, TSC, SHA, NSSF and eCitizen are used only to describe the portals and institutions our Services relate to, and belong to their owners.

2.3 Decisions, approvals and processing times belong to the relevant institution. We cannot guarantee approval or acceptance of any application, or control how long it takes, or whether a portal is available.

2.4 The descriptions on this website are summaries. The exact scope and cost of a Service are confirmed with you before work starts.

3. Requesting a Service

3.1 You can request a Service in person, by phone, on WhatsApp or through the contact form. Sending an enquiry does not by itself create an agreement.

3.2 An agreement is formed when we confirm that we will do the work, including the price where it applies, and you ask us to go ahead.

3.3 Some Services are offered only where available, for example A3 photocopying. We may decline a request that is unlawful, that we cannot do properly or for which we lack the necessary information.

3.4 Our opening hours are Monday to Friday, 7:00am to 6:00pm. Messages sent outside these hours are answered when we reopen.

4. Prices and payment

4.1 Prices vary by Service. We tell you the price, or an estimate, before we start.

4.2 Fees charged by government institutions, portals or other third parties are set by them. They are separate from our service charge and you are responsible for them.

4.3 Payment is due as agreed with you when you place the request.

4.4 If the scope of a request changes, we will tell you about any change in cost before continuing.

5. Your responsibilities

5.1 Give us accurate and complete information, and check your documents and applications before final submission.

5.2 Only give us documents, identity details and accounts that you are entitled to use. You confirm that you have the right to have us print, copy, scan or prepare any material you give us, including the necessary copyright permissions.

5.3 If you share login details so that we can complete a request, you allow us to use them only for that request. Keep them confidential and consider changing your passwords afterwards.

5.4 Provide the information and documents we ask for promptly, because delays on your side may delay the result.

6. Prohibited use

6.1 You may not use our Services, computers, internet connection or website to: break the law; forge, alter or falsify documents; impersonate another person or use someone’s identity or account without permission; gain unauthorised access to systems, spread malware or commit any act prohibited by the Computer Misuse and Cybercrimes Act, 2018; copy or print material in breach of copyright; harass, threaten or abuse others; or view or share unlawful content.

6.2 We may refuse or stop any Service that we reasonably believe breaches this clause, and may report unlawful activity to the authorities where the law requires or allows it.

6.3 You are responsible for how you use our equipment and internet connection on our premises.

7. Quality, mistakes and refunds

7.1 We take care with every request. Please check completed work before you leave or submit it.

7.2 If we make a mistake, tell us promptly and we will correct it where reasonably possible, at no extra charge for correcting our own error.

7.3 We are not responsible for problems caused by incorrect or incomplete information you gave us, or by decisions of institutions.

7.4 If we are unable to provide a Service that you have paid for, we will refund the amount for the part we did not provide.

7.5 Your rights under the Consumer Protection Act, 2012 are not affected by these Terms.

8. Cancelling a request

You may cancel a request before we start work without charge. Once work has started, you pay for the work already done and for any third-party fees we have paid on your behalf that cannot be recovered.

9. Availability

9.1 Many of our Services depend on internet connections, electricity and third-party portals. We are not responsible for delays or interruptions outside our reasonable control.

9.2 This website is provided as available. It may be unavailable from time to time, and we may change or remove content without notice.

10. Confidentiality and your information

10.1 We treat the documents and information you give us as confidential and use them only to provide the Service you ask for, as explained in our Privacy Policy and in line with the Data Protection Act, 2019.

10.2 Information about cookies is in our Cookie Policy.

11. Intellectual property

11.1 The text, design and other content of this website belong to Tajmol Cyber. You may view it for personal use but may not copy or republish it without our permission.

11.2 Your documents remain yours. We claim no ownership of them and use them only to deliver the Service.

12. Liability

12.1 We are not liable for decisions, delays or rejections by institutions; for loss caused by incorrect or incomplete information you supply; for interruptions of internet, electricity or third-party portals; or for events outside our reasonable control.

12.2 To the extent allowed by law, our total liability for any claim connected with a Service is limited to the amount you paid us for that Service.

12.3 Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or any liability that cannot be limited under Kenyan law, including the Consumer Protection Act, 2012.

13. Communications

13.1 We use the contact details you give us to reply to your request, and these messages about your request are service messages.

13.2 We will send promotional messages only if you agree to receive them, and you can opt out at any time.

14. General

14.1 These Terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute.

14.2 If you have a complaint, please contact us first so that we can try to resolve it.

14.3 We may update these Terms from time to time. The latest version is published on this website with its date, and applies to requests made after it is published. By continuing to use our Services you accept the updated Terms.

14.4 If any part of these Terms is found to be invalid or unenforceable, the rest remains in force.
